  1. Overview

This website is operated by Brisbane Fireplace & Heating (“we”, “us”, “our”). By accessing our site, purchasing from us, or using our services, you agree to these Terms of Service (“Terms”) and the policies referenced here (including our Privacy Policy and Returns Policy).

  1. General Conditions

We may refuse service at any time. Content (excluding credit card data) may be transferred unencrypted and adapted to technical requirements; credit card data is encrypted during transfer. You must not reproduce, copy, sell, resell or exploit any portion of the Service without our written consent. Headings are for convenience only.

  1. Information Accuracy

Site content is general information. We do not warrant it is accurate, complete or current. Historical content is for reference. We may change content at any time without an obligation to update. Use at your own risk.

  1. Changes to Service & Prices

Prices/availability can change without notice. We may modify or discontinue the Service (or any part) without notice and are not liable for resulting impacts.

  1. Products & Services

Returns/exchanges are governed by our Returns Policy and the Australian Consumer Law (ACL) (12). We try to display colours/images accurately but cannot guarantee your device’s display. We may limit sales or quantities by person/household/region and change descriptions/pricing at any time. Products may be discontinued without notice. Some items require assembly and/or professional installation—check product details before purchase.

5.1 Heavy/Bulky Goods & Access

Many products are heavy/bulky. You must ensure reasonable site access (driveways, stairs, lifts). Redelivery, delays and special equipment (e.g., cranage) may incur extra charges.

5.2 Click & Collect

We’ll notify you when your order is ready. Bring photo ID and your order confirmation. Storage limits apply; uncollected orders may be cancelled per policy.

  1. Orders, Billing & Account Info

We may refuse/cancel any order or limit quantities per person/household/order (including where the same account, card, billing or shipping address is used). If we change or cancel an order, we’ll try to notify you using the details provided. Keep your account, contact and payment details current and accurate.

  1. Optional Tools & Third-Party Links

We may provide access to third-party tools “as is” without warranties or endorsement and are not liable for their use. Third-party links lead to sites we don’t control; review their terms and policies before engaging.

  1. User Content, Reviews & Submissions

By submitting content (e.g., reviews, photos, ideas), you grant us a non-exclusive, transferable, royalty-free, worldwide licence to use, reproduce, modify, publish and display such content in any media, subject to our Privacy Policy. We may monitor, edit or remove content we consider unlawful, offensive, infringing or otherwise objectionable. You warrant your submissions don’t violate rights/laws, don’t include malware, and aren’t misleading.

  1. Personal Information & Privacy

Your personal information is handled under our Privacy Policy (link on site), which explains collection, use, disclosure, security, cookies and marketing communications.

  1. Errors, Inaccuracies & Omissions

Information may at times contain errors or omissions (e.g., descriptions, pricing, promotions, shipping charges, transit times, availability). We may correct or update information or cancel orders where information is inaccurate, at any time and without notice, to the extent permitted by law.

  1. Australian Consumer Law (ACL) – Guarantees & Remedies

Our goods are covered by guarantees under the Australian Consumer Law (Competition and Consumer Act 2010) that cannot be excluded.

  • If a product has a major problem, you are entitled to choose a refund or replacement. You may also claim compensation for any other loss or damage that was reasonably foreseeable.
  • If a product has a problem that is not major, you are entitled to have it repaired or replaced within a reasonable time.

Any warranties we may provide are in addition to these rights — they do not replace or limit them.

11.1 Change-of-Mind Returns (Store Policy)

If offered, change-of-mind returns are at our discretion and will require the goods to be unused, in original packaging, with proof of purchase, within a stated period, and may attract restocking/return freight fees. Custom, special-order, used, installed or clearance items are typically not eligible. See our Returns Policy.

  1. Installation, Safety & Compliance

Fireplaces, heaters, BBQs, flues and accessories may require installation by appropriately licensed professionals (e.g., gasfitters, electricians) and must comply with applicable laws, standards and manufacturer instructions, including clearances and ventilation. You are responsible for:

  • Ensuring the site/building meets compliance requirements;
  • Obtaining approvals/permits where applicable; and
  • Using compatible flue systems and fuel types.

We are not responsible for damage/safety issues arising from improper installation, use contrary to instructions, or unauthorised modifications.

  1. Prohibited Uses

You must not use the site or its content to: (a) break the law; (b) infringe IP rights; (c) harass, defame, discriminate or harm; (d) submit false/misleading info; (e) upload malware; (f) collect/track personal info without consent; (g) spam, phish, scrape; (h) engage in obscene/immoral conduct; or (i) bypass security. We may terminate access for violations.

  1. Intellectual Property

All site content (text, graphics, logos, images, product data, trade marks) is owned by us or our licensors and protected by law. You may not use our intellectual property without prior written consent, except as permitted by law.

  1. Limitation of Liability

Subject to §12 (ACL) and to the maximum extent permitted by law, we exclude all warranties, representations and conditions not expressly stated. Where liability cannot be excluded, our liability is limited, at our option, to repair or replacement of goods, resupply of services, or the cost of doing so. We are not liable for indirect or consequential loss (e.g., loss of profit, revenue, savings, data or opportunity), except where required by the ACL.

  1. Indemnity

You indemnify and hold harmless Brisbane Fireplace & Heating and our officers, employees, agents and contractors from claims, losses, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or violation of any law or third-party rights.

  1. Severability

If any provision is unlawful, void or unenforceable, it is severed and the remainder continues in effect.

  1. Termination

Obligations and liabilities incurred prior to termination survive termination. These Terms remain in effect until you or we terminate them. You may stop using the site at any time. If we suspect breach, we may terminate without notice; amounts due up to termination remain payable.

  1. Force Majeure

We are not liable for delay/failure to perform due to events beyond our reasonable control (e.g., accidents, natural events, labour issues, transport/supply disruptions, government action, utility failures).

  1. Governing Law & Jurisdiction

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and courts of appeal.

  1. Changes to Terms

We may update these Terms by posting a revised version on our site. Changes take effect upon posting. Continued use constitutes acceptance.

  1. SMS & Electronic Marketing

By opting in (e.g., at checkout, account signup or via on-site forms), you consent to receive marketing and transactional messages from us (email and/or SMS). Under the Spam Act 2003 (Cth):

  • We will only send with your consent and will identify Brisbane Fireplace & Heating as the sender.
  • Each message will include a functional unsubscribe (e.g., reply STOP for SMS, unsubscribe link for email). Standard carrier/data rates may apply.
  • You can opt out at any time by using the provided link/reply or contacting us at [insert email]. Opt-outs are actioned within a reasonable period.
  1. Pre-Orders & Special Orders

Pre-order dates are estimates and may change due to supplier or freight delays. We’ll keep you updated and offer options if delays are material. Deposits on special/custom orders may be non-refundable where permitted by law (ACL rights preserved).

  1. Pricing, Promotions & Errors

We may correct pricing errors. Promotions may have eligibility criteria, time limits and cannot be combined unless stated. Gift cards/credit notes are valid as stated at issue and are not redeemable for cash unless required by law.

  1. Risk & Title

Title passes on full payment. Risk passes on delivery to your nominated address (or upon collection).
